Spinal Cord Injury
The term "spinal cord injury" covers any damage to the spinal cord that results in a patient's loss of mobility, sensation, or functioning. According to the Mayo Clinic, each year over 11,000 U.S. citizens suffer a spinal cord injury. Like a traumatic brain injury, a spinal cord injury can leave a person permanently disabled. Many of these injuries result in permanent loss of sensation, paralysis, and/or loss of control over bodily functions.
Spinal cord injuries fall into one of two categories: complete and incomplete. A patient with a complete spinal cord injury has lost the ability to control movement or feel things in some part of the body. An incomplete spinal cord injury, on the other hand, leaves the patient with some ability to move or feel sensations. However, the ability to move or feel is impaired, and the patient's ability to function normally may be lost. The closer a spinal cord injury is to the head, the more areas of the patient's body will lose sensation, motor control, or function.
Approximately 50 percent of spinal cord injuries occur due to automobile accidents. Falls account for another 24 percent of spinal cord injuries, while assault is responsible for another 11 percent. Often, a person who experiences a spinal cord injury in one of these ways is not responsible for the injury. This person may have a valid legal claim against one or more people or companies whose negligence made the spinal cord injury a tragic reality.
To demonstrate another person's responsibility for a spinal cord injury in court, the patient must show that the injury occurred and is real; that it was not a pre-existing condition; and that but for the carelessness of another party, the spinal cord injury would not have happened.
Negligence causing spinal cord injury can occur in many ways. Sometimes, car accidents or motorcycle accidents in Indiana are caused by negligent drivers that fail to pay attention to the road, resulting in spinal injuries. In other instances, a defective part in a vehicle causes an accident, leading to spinal cord injury. A slip and fall, a construction site accident, medical malpractice, or surgical malpractice may also result in spinal cord injury.
When a spinal cord injury occurs, it can leave a devastating and permanent impact on the patient and their family. Other people or companies responsible for the spinal cord injury can be held accountable for expenses associated with the injury such as medical and hospital bills, physical therapy and rehabilitation, and ongoing or in-home care. They may also be held responsible for paying lost income, property damage expenses, and costs related to the pain and suffering that comes with a spinal cord injury.
