It may take some time for insurance companies to work out who should pay. Also, the law holds employers liable for the actions of its employees while on the job and acting within the course and scope of their employment. That means the employer may, and usually does, aggressively try to deny liability or to otherwise attempt to water down the value of the injury victim's claim.
