
Wrongful Death Motorcycle Crash With an Intoxicated Driver

Our client was fatally injured in a motorcycle vs. vehicle crash. He was traveling straight when a vehicle turned left in front of him. The defendant driver was intoxicated and tested positive for THC. However, the insurance company continued to claim that our client had large comparative fault given the speed he was going and since their insured said that he did not have his headlights on at the time of impact. We had to investigate the black boxes from the vehicles and send the headlamps for testing. Upon further investigation, we were able to learn that the defendant driver had a separate insurance policy with additional coverage to help aid our client’s family. We were able to prove that our client was not at fault for the crash and secured maximum recovery from both insurance policies.
